We rented an Rv from Cruise America for 23 nights with the 0 damage plan. The 2nd day we had it , I was reversing down our drive , I pressed the brake, nothing happened the brake failed and the Rv crashed into the side of my house.
I took out the 0 damage plan so damage to the Rv isn't an issue.
The day after the accident at 8am the Rv was towed back to cruise America for them to run diagnostics. I called CA at 3pm to see if any news I was told it was being towed to ford and someone would contact me Friday. Friday 2.30pm I called back, no new updates, was told my assigned case worker would call back, no one did.
Today is Sunday and we are still without the vehicle and without any communication
It's been 4 nights without the Rv. I would like to request CA cancel the whole booking and refund but that is against their policy.
What legal recourse do I have? I was thinking I can just get my credit card company to do a chargeback, for services paid for but not provided? But that would only cover the nights without the vehicle. Are there grounds on which I can cancel my rental agreement and get refunded?
