TLDR: I registered a guest pass at 1am, was towed at 4am for not having a parking permit. Can I sue for that tow?
To preface- I do not live at this complex, my partner does and I spend most of my nights here rather than my own apartment. I have been staying over regularly for about 3 years, parking this specific car there for a few months. I had been under the impression that there were specific guest parking spots and was towed for the first time a few weeks ago for not having a guest permit. I then asked my partner to get me a guest pass almost daily and was towed again about 2 weeks after the first incident (he paid since it was due to his negligence). That was only a few days ago and was towed again last night. I had registered my car under a guest pass around 1am (the passes are only good for 24 hours and I hadn’t planned to sleep over last night initially). I called the apartment’s office and was told I was towed at 11:30pm and my pass was made at 1am, but that they will ask the towing company to release my car without fee. Now I knew that was not true because right after I made the pass I went to my car and got my overnight bag. I just picked up my car and the towing company receipt says they were called around 4am and towed about 4:30am.
Since I was legally parked can I sue the apartment complex for towing me? I just want back what I paid for the first two, and maybe to cover one of my classes as the first time I was towed it made me miss an exam and I had to withdraw from the class.
