Hi guys, I wanted to seek your advice on a slip and fall accident I had while helping a customer in MN and whether or not I have a case worth pursuing. For better clarity I am 33yrs old and I co-own the moving company. Here is the accident report.
Accident Report Date of Report: 10/31/24
Date and Time of Accident: October 31, 2024, 11:25 AM
Location: Customer's Residence in Minnetrista, MN
Weather Conditions: * Morning: Rain * Mid-Morning: Transitioned from rain to snow * Temperature: Approximately 42 degrees Fahrenheit * Surface Conditions: Wet and slippery, with no preventive measures taken by the client to address ice formation or traction hazards.
Incident Summary:
A team of four movers was hired to load two 26-foot U-Haul trucks rented by the customer at their Minnetrista, MN residence. Due to the wet and icy conditions from rain and snow, the driveway and truck ramp became extremely slippery. The customer did not take any action to salt or otherwise improve the traction of these surfaces. At approximately 11:25 AM, while carrying a box down the unsalted ramp of one of the U-Haul trucks, I slipped and fell. This incident resulted in significant injuries, which required immediate medical attention.
Injuries Sustained:
- Moderate synovial effusion (swelling and fluid in the knee joint)
- Bone contusions (bruising) at the femoral condyle and the proximal tibial epiphysis, indicative of trabecular microfractures
- Partial tear of the fibular collateral ligament
- Full-thickness tear of the patellar tendon, causing proximal patellar migration
- Rupture and retraction of the quadriceps femoris muscle, with extensive signal alteration in the vastus lateralis
- Partial tears in the medial and lateral patellar retinacula
- Extrusion in the lateral meniscal body consistent with a free-edge radial tear
- Posttraumatic Hoffa's fat pad edema
- Partial tear in the medial collateral ligament
- Grade 1 sprain in the lateral collateral ligament
These injuries led to intense pain, swelling, limited mobility, and an inability to work effectively. Treatment for these injuries is expected to involve surgery, extensive physical therapy, and a prolonged period of rehabilitation.
Consequences and Impact:
- Medical Bills:
- Significant expenses related to emergency care, diagnostic imaging, surgical intervention, and ongoing physical therapy.
- Loss of Income and Work:
- As the owner and an active member of the moving crew, this injury has prevented me from performing my duties, leading to lost income and reduced efficiency for the business.
- Rehabilitation:
- Long-term physical therapy is required, along with potential rehabilitation to restore strength and range of motion in the knee.
- Future Risk and Limitations:
- There is a possibility of long-term mobility restrictions, chronic pain, and a need to modify work activities to prevent re-injury.
