So my parent was pushed at work by a co-worker, this same co-worker called her the N word and used that word a few times in her presence. The attack was in front of another person and her director said she was the aggressor even though she was attacked, they regularly bullied her. This happened almost two years ago and it was pretty traumatizing and we thought it best she take a leave of absence and filed a complaint against them. During this time, they wouldn’t pay for workers compensation and we received short term disability but that ran out so I been supporting our household myself for a year and half until my sibling got a job recently and can assist. Through this time they’ve also been harassing her and putting her down even when there not supposed to talk to her.

They called the day before and told her they would deny her workers comp based on her QME from THEIR doctors which said her health issues were due to her being old and my mom no where near 50 yet, even though she has medical records citing the fall as the source of her pain, multiple.

My mother just had her disposition and it more or less went badly. Before the call happened, her lawyer, who’s pretty terrible , called and said they wanted to settle for $20k. My mother turned it down citing her trauma and bringing up she wanted to keep her position with higher pay. Then the netting started. They attacked her mental health, called her crazy, brought up my father and why didn’t they work out, brought up my income and my sexual history, brought her relationship with her family, brought up her weight, called her delusional, a lot of stuff that had NOTHING to do what happened at her job. It was so invasive and attacking and her lawyer sat and did absolutely nothing. There only defense was that they said they found multiple people who were even there when the attack happened saying that my mom was the aggressor. And when my mom brought up her attacker called her the N word, the lawyer on their side said that it wasn’t true and they don’t think her attacker is that kind of person. There supposed to be a part 2 discussion. A few hours after the call they called back and offered 25k and she turned it down.

Then I just learn tonight that her lawyer told her she should take the deal because she had a weak case. He really hasn’t been helpful during the process and I wish she would of listen to me in the beginning and file an EEOC case, she tried to find another lawyer but kept getting turned down for reasons I don’t, I didn’t ask, so she kind of stuff with this guy who really doesn’t care at all. So my mom kind of in a mood but during the disposition she never got upset, she never cried nor took the bait when they kept provoking her hard while her lawyer did nothing to stop it.

I just want to know what’s the likely outcome? She’s hoping for 60k and her position but they’re increasing the offers slowly and her lawyer isn’t hopeful (nor care). Or what should she do if anyone been in this situation? She got a pretty solid case in my opinion.
