I apologize for any bad grammar and punctuation in advance. At 8:04am on the 8th of Oct, I was hit by a drunk driver on my way home from the gym. He tried to get away but there was a state trooper on the scene so he stopped, and while on cam, admitted that the accident was his fault. On top of that, the car behind me provided me with dashcam footage of the whole incident.
Unfortunately, the police report was delayed and I only received it yesterday. The person at fault had their insurance expired and will therefore not be held liable, or so I'm told. Meanwhile, my insurance is offering to pay only $30k, on a car that cost me 52k. I have 12 paid off but that still leaves me with a full 10k to pay.
I want to take legal action against the person responsible for the accident, for the damages to my car, as well as all the other expenses I have incurred since then due to this whole issue. Should I pursue this, and if I do, what should I expect out of it and how much should I keep in mind for lawyer fees?
