Hi all,

I have been in a moldy leaky shithole of an apartment in north Georgia since December 2023. My original lease is due to end on 12/31/2024, but due to an ongoing and completely unsolved list of problems (front door doesn’t seal, AC broken all summer, pool never opened, dishwasher not mounted properly and doesn’t drain, pests, BLACK MOLD in the entire bathroom ceilings/walls, leaks and unresolved water damage, the list goes on and on) we had requested one of three things from our new management company: 1. To switch units (this was top priority), 2. Financial compensation/reduced rent while fixing items, or 3. To terminate the lease penalty free (least favorable, due to current rental rates). This request happened back in August.

On September 11th, we received this email “Per your request, we spoke with the owners and they will allow you to end your lease without incurring lease breaking fees with a 60 day notice. Your lease end date is November 11, 2024. Your remaining monthly rent payments are to be paid to the end of your 60 days in compliance with the terms of your lease. Your security deposit cannot be used as rent payment at any time. After you vacate the premises, an inspection will be made to ensure that the leased premises have been cleared of all furniture and personal items and left in a clean and undamaged condition. Al keys to the premises must be returned to the landlord when you vacate to (address) by November 11, 2024. You must also provide the landlord with your forwarding address. This letter serves as legal notice of termination of your lease on the referenced property. It is also intended to allow you ample time to seek a new residence. Failure to comply with the above requirements could result in legal proceedings to regain possession of the property. Failure to act in accordance with your lease can also adversely affect your credit rating. We would like to thank you in advance for your cooperation. “

and I replied by calling them and asking why we couldn’t switch units or have compensation, reiterating that my LAST choice was to terminate the lease, to which they replied “the owners are currently declining all unit transfer requests.” And I hung up. After weeks of not finding a place to stay (going in person and asking, applying online etc) I sent a reply with a simple request to essentially deny their notice to terminate the lease, as we need more time to find a new place: “Hello, There’s currently no places available that we are able to get right now, we are requesting that we can finish our lease through the end of the original term stated in the lease (12/31/24). If someone could please call me back as soon as possible, as this is an urgent matter. Thank you”

To which they replied a couple hours later “Unfortunately, that will not work; you will need to be out by 11/11/2024. Thank you.”

I never signed anything to agree to end my lease early, and haven’t done anything for them to evict me, so my questions are- how should I respond? And do I really need to be out by 11/11 or does that notice have legal standing? This is in Hall county, Georgia, USA

Edit: I would like to add that the moldy ceiling was cut out and replaced.
