I had to take a pre employment drug test. I have never failed one. Being a commercial truck driver for over 6.5 years, I do not do drugs as I have tried very hard to protect my license. I know I was and have been clean of drugs for decades. Yet, for some reason, I failed a drug test 1.5 weeks ago and was told I could not retest since they waited 5 days to inform me of this, and the requirements are within 72 hours. Now I do not do drugs, cbd, or even drink alcohol. As I love my profession. Now, FMCSA has a drug and alcohol clearing house where all testing is reported to. The lab would not test my 2nd sample. Nor would they send me any documentation showing this so-called failed test. Now I know it was a false positive. But due to their not following protocol nor allowing me to retest, they reported me to the clearing house, suspending my ability to drive commercially, which has destroyed my livelihood. I just had another drug test taken, which I passed, of course, due to me not using illegal drugs. Now, since this lab destroyed my livelihood and had my cdl down graded as of 18 November 2024....what legal response do I have available yo fight this injustice? I live in Pennsylvania, USA. I have had to start the SAP process of getting back to be able to drive. And even there the SAP counselor has ME going through alcohol treatment instead of what I supposedly failed the urine test for. What are my options, please? I'd like to sue the lab that did the testing. I'm not the only person who has had issues with those labs, apparently. They have destroyed my livelihood and my reputation as a commercial heavyhaul truck driver. Please let me know. And if an attorney would like to take this case on, if this option is open, to sue them, please take me on as a client. As stated, I have never failed a drug test. And just past one for a temporary job till I can get my CDL clear of this injustice.
