A remote offshore employee of mine moved to the U.S. on a travel visa. Do I have to fire him?

I have a remote offshore employee who works for me 1099 and pays taxes in his country of origin.

They are trying to become a US citizen, and so in the meantime they secured a travel visa for the U.S. and are living with their family in the U.S.

They do not have “work authorization”, but they were working with me prior from their home county - they are just moving their laptop to US soil effectively.

What do I need to do to remain compliant?
