So my company uses the Fuego app where we can take out an advance on a paycheck. It turns out that Fuego failed to communicate properly with my company, and over the course of the last year and a half, they've failed to take out ≈$3,500 from my paychecks.
I'm being informed now that I must pay this back, and I've had my wages garnished without any warning or asking for my consent, which left me $700 short this last paycheck. HR told me that they will be taking out $750 from the next four paychecks and $50 from the one after that.
From what I can find, a company is not allowed to correct an overpayment made over 6 months ago, they can't take more than 15% of my wages without my consent, and they can't leave me with less than I'd make on minimum wage. All of these things are exactly what is happening here.
Is my understanding correct, and what can I do about it?
