Maintaining a Common Nuisance, if the other persons charges were dismissed that means no nuisance was ever established.... Can they still charge me?
Post Body

My husband was charged and arrested for possession last Feb. All the found was paraphernalia and an empty baggie. A little leftover dust on a table. He was in jail for 15 days and got out. 2 weeks later after several attempts to get me to work for them failed I was charged with maintaining a common nuisance. 35-45-1-5(c)/F6: Maintaining a Common Nuisance - Controlled Substances My husband told them from the beginning that I had no idea he had stuff at the house. Now my husband (i miss you so much) passed away at the end of May, so his charges were dismissed. If he was never convicted of anything at that house and neither was I can I still be charged with maintaining it? No nuisance was ever established. Oh this is all in Indiana.
