My wife and I bought a house together a year ago. We've been married roughly 2 and a half years and things just aren't working out so I suggested divorce.
Throughout our short marriage; I sold 15k worth of personal belongings and have it documented over paypal that it was sent to her. In this time I also emptied out a 401k [roughly 7k] these were used to pay for vacations, debt, and getting things started for the house.
She has a rather large car payment (29k) and can't afford the house on her own. We owe 129k on the house which is current appraised around 145k. We have a standing loan out for 12k for replacing the Furnace a few months ago.
Ideally I think I want to buy her out of the house; I feel if we sold the house we'd barely break even after paying realtors and paying off the loan for the Furnace.
She's claiming all the money I gave her to out towards bills, vacation and everything from the personal belongings and 401k are Marital property even though it was all acquired before the marriage.
Any advice on what I should do or what direction I should move?
