In IL. My dad passed in 2021. The circumstances around his death were complex involving a brain injury sustained on the job due to being hit by a train while he was in his work truck. The train company and my step mom were in court for three years and she won the case. This settlement was to be paid out to my step mom, me, and my sister. We have not even started the estate split process. This settlement happened 7 months ago and when my step mom contacts the lawyer he tells her he’s still working on it. She only started asking recently. She isn’t a pushy person. And I don’t think I have a right to contact because I wasn’t in court. I’m Not pushy either. So. We are just waiting. For what I don’t know. Any insight or advice would be helpful. I wonder if the settlement is being absorbed into the estate? Or if the lawyer is holding the money? He has all retainers up to date.
