This might be a long story, so here we go.
I went into Sam’s club in Florida to have my tires inspected and balanced. The first employee goes into my car, and says afterwards “I can’t start the car.” Me, being confused, shows him how to start my car, it’s a BMW. He then says “even if you can start the car, I won’t work on it, because I’m scared of electric issues.” The electric issue he is talking about is nonexistent. He’s referring to when I pushed the start button and my dash trim was a little loose due to a broken plastic piece. I then said “have you ever worked on a German car before?, and he gets defensive saying how he thinks I’m calling him stupid. Again, he still refuses me service.
Next, I grab the manager and the second employee comes out, and at this moment I’m already pissed with the first employee so I start filming with my phone because I think I’m being discriminated. So, the manager comes out and gets another guy to work on my car. He then says “we can’t bring it on the lift because a jack point is broken.” At this point, I think they are refusing to provide me service out of spite, so I go ahead and go into the tire department and continue recording the employee and manager who is walking away from me refusing me service. Then, out of nowhere the first guy that initially refused me, comes out of nowhere and snatches my phone from my hand (all of this is recorded by phone and CCTV). Next, he takes my phone and I try to grab it back, I don’t touch him in an aggressive manner or anything, I just try to get it back but he’s keeping me away by making an arm barrier against my neck. He gives back my phone after a couple minutes when the manager tells him to give me my phone back.
Afterwards the cops were called by the general manager and then I called the cops as well. The cops take the manager and the employees side of the story first and then they come to me for my side. I show the cops the recording of the video of the guy that grabbed my phone aggressively, and the cop says “that’s good enough” and gives me a form to file charges for battery.
The main question is: Are my chances good of winning the case, can I sue Sams as well as the guy that committed battery? Is this battery, assault, and theft? Please let me know, thanks for listening to my story.
