My car was legally parked on the side of the curb when it was hit by another driver who is 100% at fault. The other driver's insurance company is not offering a fair estimate to cover the full cost of repairs, not providing me with a rental vehicle that is needed to restore my car to its pre-accident condition and assist me with a vehicle in the meantime. My car is inoperable and it wobbles when I try to drive it and I believe they are acting fraudulently by underestimating the damages and refusing to pay what is necessary. How am I supposed to go to work without a rental?
I want to know more about how I can sue the insurance company. Specifically, I’m looking for information on the legal options available to hold the insurance company accountable for the inadequate repair estimate and ensure they cover the full cost of repairing my vehicle to its original state in addition to providing me a rental. They told me I should get the rental under my own insurance but that costs $45/day, why should I have to pay anything and go through my personal auto insurance when the other party drove into my car and I wasn’t even present during the accident. The other party is liable for the damages and is agreeing to accept fault.
