So long story short I had a busted shower pipe in the wall that was leaking over the course of 5 years, I just bought the house last year, 6 months ago the the leak made itself evident to the neighbors below me. Right on time for me. Everyone thought insurance would cover but insurance doesnt cover extended exposure water damage (great!), so they denied everyones claims. Not only did I have to remodel my bathroom for the damages (10k in repairs), the HOA is charging me another 10k to repair my neighbors bedroom remodel, because of the mitigations. This leak was inside the wall, unbeknownst to anyone. The HOA's bylaws clearly say that omitting negligence or willful misconduct, theyre the ones responsible for common area and building structure maintenance and repairs. I did my due diligence quickly for my own repairs (which needed to be done before my neighbors repairs). I was not negligent nor committed any willful misconduct. State Farm denied coverage for them based on that clause, that I was not liable for the neighbors damages. HOA nevertheless tells me im responsible and that theyll charge me, I get a lawyer and give a dispute letter, and dont hear from the HOA for 4 months! Then out of no where i get hit with a 10k assessment charge. What can I do in this situation? My attorney who helped me with the dispute letter is MIA, hes not responding to any of my emails (all im looking for is advise for course of action at this point). State Farm is adamant that what the HOA is doing is wrong, yet are completely disinterested in helping me settle this. In IL.
