My friend fell and hit his face in a bar he began to bleed so I carried him out; then a few cops came and wanted to take him into an ambulance. I told them âno Iâll walk him homeâ as I was unsure if he had health insurance. They insisted and I said âno I donât want him to pay for a taxi ride to the hospitalâ
They said if I didnât move theyâd arrest me and then I told them it would be an âunlawful arrestâ. They proceeded to start touching me, so I decided to grab onto a stop sign for some reason till they ripped me off. (Youâre allowed to resist an unlawful arrest in my state) I know it was stupid though.
I was then frisked and illegally searched, violating my 4th amendment rights, after first violating my 1st amendment rights.
I didnât have a wallet on me so they asked my name and I refused (my state doesnât have a Stop & ID Statute) I was then placed in the back of a squad car. At this point an officer began questioning me (I wasnât mirandized does this count as the beginning of questioning?) I wasnât informed of any of my rights throughout the process, yet they held me for 12 hours. I never gave my name , but they booked me and figured it out.
I donât have any prior criminal history, but I was belligerent throughout this whole ordeal. (I was being an asshole, but thatâs no crime) They booked me for disorderly public intoxication ( I didnât consent to any tests) and disorderly resist & obstructing.
My question is can I get this dismissed, Iâm going to request body cam footage, acquire the police report and be arraigned; entering a plea of not guilty before I proceed with getting a lawyer. I feel it is an open and shut case and have thought about defending myself pro se. (Iâve watched too many movies but eh)
Iâm also interested in pursuing civil litigation, any thoughts on some resources I can obtain before I go through this whole process?
