My father is currently trying to get a restraining order and PO order against me because I (24 f) came home late from the movies w someone he doesn’t like. I pay bills and rent while living with him. I will be fighting the order and placing my own against him as I have a decent amount of evidence of him being violent towards me (broken finger, marks on neck from being choked, arm on verge of fracture from being body slammed) I never called the police as that’s my dad. A day or so ago I came home where I share our place with him at around 2-3 am. I left my phone in the uber I took back and asked him to call it. He refused cause he was upset with who I went out with and that I went out at all. 20 mins go by I have no way of calling or even figuring out my phone as we don’t have WiFi and can’t get it at our residence. He called the police and lied telling them I threatened him with violence and was causing a disturbance. Mind you I am 5’3 130 lbs. he is around 5’7 over 200. He works a blue collar job extremely strong. He is able to body slam me and have evidence of. My mom passed from heart failure when I was 15, he was abusive towards her and had the cops called multiple times against him but she always excused him. I need to know how to access the police records of when those calls took place to prove I am not the violent one. I haven’t even gotten into a fight in school let alone swung or acted first. I have autism and get emotional sometimes but have never laid a hand on anyone. I can’t have this on my record as the field of career I’m trying to get into will completely deny me anywhere with it. If anyone has any idea where I can try to get those records I would extremely appreciate it. It was in La mesa/San Diego, California around 2008-2010. My mom passed in 2015 and she had been separated from my dad for two years by then I didn’t have communication with him that whole time due to what he did to my mom. When she passed I had no choice but to go with him. And now I might be charged for violence when he caused my mom to die and I have broken bones and so much trauma from him. It’s just not okay so please, if anyone has any type of info on how to get those records I would greatly appreciate it.
