Going to give a quick rundown of the incident: I (as in myself, not my vehicle) was hit as I was crossing a crosswalk to the Walmart nearby two days ago. The vehicle did not stop and left by the time I came to consciousness.
I got out of the accident with some cuts, bruises, and a concussion. I was very, very lucky. I have good insurance and was able to go to urgent care and have the majority of my medical items paid for.
The police there did not file a report because it was on private property. There were witnesses, but I did not get any names. I was very dazed and could not think properly to get any information after the incident.
My husband is saying we need to go to a lawyer and pursue it because the person who hit me should face jailtime because they could have killed me. However, it would cost me more to retain a lawyer than to pay for my medical bills. I don't believe it is worth pursuing, and it would be a waste of time since I have no information and the police did not file a report. I also do not want to miss work for all of this. But I do not know if this is the right thing to do. My reasons for not doing it is selfish and I am aware someone could die because of this person if they hit someone again. So I am torn.
Do I have a case? Should I cut my losses or can this be pursued? Should this even be pursued?
