As a preface: I have booked a consultation with a tenants rights attorney for later this week to better understand my legal options. Not looking for specific legal advice here, but I am interested to know if anyone else has been in the situation I'm currently in. Would love to know more about your experience so I can get a better idea of what to expect going forward.
Basic facts: I sublease from the original tenant in Portland, Oregon -- we have a basic month-to-month written agreement -- and he has his own month-to-month lease agreement with the landlord. I have lived in this house for around 3 years now, and the original tenant has lived here for around 5 years. The landlord and I know each other (this is not an illegitimate subleasing situation) and I have interacted with him/asked for house maintenance directly etc. He knows I exist, he knows about the sublease agreement, it has always been cool between us. I pay my rent to the original tenant, who pays the entire rent amount to the landlord. The landlord knows I'm paying rent to him through the original tenant.
The situation: The original tenant told me this weekend that he will be moving out Aug 31, and he has informed the landlord of this. He indicated the landlord is not interested in renewing the lease at this time (I suspect he might be planning to sell the house and is taking this opportunity to do renovations/repairs). So with the original tenant telling me he is moving Aug 31, and me having a sublease agreement with that person but not the landlord, where does that leave me? I haven't been able to speak with the landlord about this yet, but I'm hoping to do that in the next few days. In the meantime I'd like to figure out where I stand, which is why I'm posting here and why I've booked a consultation. Moving out by Aug 31 would be extremely difficult for me and would disrupt a lot of plans I have already made. If I can't work out an agreement where I'm taking over the lease, I'd at least like to extend living here temporarily to give me time to move.
These are my goals, in order from ideal to not ideal:
- Work something out with the landlord and take over the lease indefinitely (unlikely, from what the original tenant has indicated, but I need more information)
- Work something out with landlord to continue living here on a temporary basis (unclear how that would work, need to talk with him)
- Leverage legal rights (if they exist for a subletter in my situation) to stay longer
- Move out by Aug 31 when the original tenant moves out
