Landlord did not give us sufficient notice and is probably changing lease date

Family is renting a house in California. they've been there for a year and a month. Landlord handed them a notice of lease termination on the 13th of july. the month to month lease was signed June of last year. Wants them out next month on the 14 of August. On the 16th of this month landlord gave a notice of lease violation with the lease date showing October of 2023. Sister's driver door window was broken last week (nothing stollen) and we believe it was the landlord. We don't have proof so can't do anything about that. Mother wants to go to small claims asking landlord for money to move out on the requested date. Is this the right choice or should we go a different route?
