I moved out of my last apartment April 30, 2024. I had to move out of my apartment because of loud neighbors on either side of me. Instead of them doing something about it, I was treated like I was being oversensitive and I was the problem. I had to go to the regional VP to be let out of my lease. I have in writing that I was able to move out WITHOUT penalty. Upon move out I asked to be called when the walk thru was done, DIDN'T get called. I was told I'd receive photos of any damages and an itemized list of what they were charging for. DIDN'T get that either. Last week I had to email them and tell them at over 60 days since move out that I never got a refund check. They said they'd check with their IT & Accounting team and reach back out to me. They called me on Wednesday to say that they were cutting me "another" check. I got the check this morning and it's $111, not $300. It's approaching 90 days now. Tennessee Code Annotated ยง 66-28-301(g)(1) states that a landlord is supposed to provide you an itemized list of any deductions they're taking from your security deposit and return the deposit within 30 days. That clearly didn't happen. Any advice on how I should proceed? Should I go back to the complex manager or go back to the regional VP or straight to small claims? I just wanted a clean break from this place and I'm not getting it. I'm FED UP. Any Advice on next steps would be greatly appreciated. Edit: I have photos and video from the day I moved out showing no damages other than wear and tear. Carpet was even cleaned.
