I'm in Florida. Recently I bought solar panels for the first time for a company. They were all on a single pallet together, and was told the forklift driver was gone for the day so I would need to break down the pallet and load them separately. Two employees stood by as I did this.
As I was loading them, I was unsure if they were all part of the same order, so I asked them if they were sure the whole pallet was my order. They assured me "one pallet one order". I continued to load the panels. When part of the panels looked different, I asked if they could check the purchase order and verify. This was mostly because I live an hour away, never usually drive down that way, and I was also loading these by hand in 100 degree heat index. The employee went off into the office, came back, and said again along the lines of "one pallet one order". In all I had them verify three times.
A couple of days later, I get a message from the company saying the order was wrong, they gave me too much, and they would like me to return them. I presume I am required to return these based on https://www.reddit.com/r/legaladvice/comments/bldxzi/a_store_gave_me_more_items_by_mistake_am_i/?rdt=55974
I'm fine with that, but believe they should come to my house to pick them up. I have already been put out a couple of hours loading, and then later unloading and safely storing what I now know were excess panels. So the question - am I legally obligated to drive them back to the store, putting myself out another 3-4 hours and the cost of gas for their mistake, or can I require they come to my house and pick them up themselves?
