So my older brother had a massive stroke that left his left side paralyzed. He's currently in recovery/rehab. He's going to be released in 10 days from his rehab facility. The issue he is facing is that his wife won't let him return to his home. She doesn't want to deal with caring for him. He essentially will need 24-hour care. He's fully conscious and in my opinion his mental capacity is about 90% and getting better everyday. What are his rights in regards to being able to return home with or without his wife's permission. Our mother and father live directly across the street from my brother and I live about a mile down the road. If he were to come home he is eligible for someone to help him 20 hours a week. Other than that, family members will have to help him. Basically just helping him shower and move from bed to chair to toilet and also helping with medication. The family really wants my brother to return home because every doctor is saying that is where he'll get the most gains in recovery. My brother is a federal employee so his disability pay is really good. Also, his insurance is pretty decent too. He also has an 11-year-old son that is at his home as well.
