I was just called by a law office claiming they are filling a civil suit against my mother for unpaid credit card debt. I explained to them that she is a dementia patient in a nursing home and is on Medicaid with zero assets beyond her monthly SS payments that go directly to Medicaid. They then informed me that I am responding for the debt in the state of Michigan. They informed me I will be served as the defendant. I am pretty sure this isn’t legal. But if I’m served and don’t show up can they actually hold me responsible for this debt? It’s 10k.
Edit: they also have made the claim that she specifically signed a contract saying They can collect from next of kin or power of attorney! That can not possibly be a thing can it?????
