I live in NYC and the car i got was in Chicago, Illinois. It’s a 2018 suv and it 21k miles on it for $30k. I put down half and the rest is a loan. The carfax was clean, 1 owner, no issues, just routine maintenance. I also got a 3 year extended warranty for mechanical repairs. When it got here in NY on the car trailer, the car’s battery is dead and needed to be jumped. That’s problem #1. That day i let in run in park for a little before driving and it felt like a new car. As i drove it around the block things became more noticeable. There was rattling every time i accelerated on the gas around 2-3k RPMs problem #2. . The next day i turned on the car and the CEL light came problem #3 on and engine started rattling on cold start. I then took it to a shop for a diagnostic. 6 codes popped up (problem #4): misfires in 1&4 cylinder, transmission error, airbag failure, engine error, etc. they did an oil change and found metal shavings in the oil and oil filter. The technician says the rattling is the main bearing being gridded up. The paperwork for the car says the engine and transmission is in perfect running condition and was checked by technician. “If anything goes wrong in the engine or transmission the dealer will have to fix”. We both signed the agreement on that.
So now I’ve tried contacting the dealership for a full refund and they seem to be avoiding me for obvious reasons. They told me the car left perfectly fine and sounded like a new car when it left their lot. I’m now going to make a lemon-law claim and sue them for selling me a car with no issues.
Overall: i was sold a defective car when it got off the truck and the dealership isn’t taking responsibility.
Do you think i have a strong case here?
