I have two questions
Question Nr. 1
I live in Switzerland and want to make Youtube Videos, where I would also have to use copyrighted material.
In Switzerland, as far as I‘m aware, whenever you want to use copyrighted material, you will have to ask the creator for permission to do so, except it is for private use. In the US, there is the concept of „fair use“. Since Youtube is a US American company, it falls under US American law. Also, I would primarly use content from US American creators because my videos would be in English. So, if someone were to sue me, they‘d have to do so in overlapping jurisdictions.
My question is: If I use copyrighted material, in a way that it falls under the doctrine of fair use, could I still get in trouble because this concept doesn‘t exist in Switzerland or is it ok because youtube falls under US American law?
Question Nr. 2
I am planning on making a YouTube video on a social issue. Does it fall under fair use, if I take a screenshot of an image or an article that is relevant to what I’m talking about and include it in my video? The text shown in the article would for example show a definition or describe a situation that I’m talking about. Of course, I would formulate what is written there in my own words.
