My (ex) wife and I will be filing for divorce in the next couple of weeks. We've split everything amicably this far and it appears that will continue. Can we just include each of our 401k's as part of the asset division without needing to file extra paperwork? Neither of us wants a portion of the others retirement (only been married 3 years). I've searched online, but it all speaks about the judge making a decision, and not a lot about what it looks like if asset division happens without need for court intervention. Living and filing in Washington State if that helps. Thanks!
