I live in a condo in the downtown Austin, TX area. To get out of our property, we need to cross over a 20'x20' section of concrete pad that belongs to our neighbor. We have an easement in place that gives us that right. Everything was fine when the neighbor was a condo complex and it was in their best interest to maintain that concrete pad as they exited across it as well. The HOA has since been bought out and there is a high-rise being built at this location. There are now major ruts in the pad that make crossing it very difficult and damaging to vehicles that is a result of the heavy construction traffic. TL:DR Does the owner of the concrete pad in which we have an easement to cross have an obligation to keep up the condition of the pad so that it is somewhat drivable?
