Dissolve/Modify Injunction | FLORIDA
Hello Friends
So I'm helping a friend of mine file some paperwork (trying to avoid a lawyer bill)
He has a "Permanent" injunction/no contact order against him that does NOT have to do with domestic violence.
He is trying to dissolve that order as circumstances have changed drastically.
We are planning to file this document: Dissolve/Modify Injunction | 12.940 Forms D - E plus the forms it mentions inside of it. As it seams that's the best option that we can find.
However I'm a bit perplexed on some verbiage used in the document.
" This form should be typed or printed in black ink. After completing this form, you should file the original with the clerk of the circuit court in the county where the injunction was entered and keep a copy for your records. You should ask the clerk to process your motion through their emergency procedures. A hearing will be held within 5 working days. You should ask for the date and time of your hearing and should file Notice of Hearing (General), Florida Supreme Court Approved Family Law Form 12.923 or other appropriate notice of hearing form, and send a copy to the other party "
How are we/he suppose to send a copy to the other party if he isn't legally allowed to contact them? It says you can mail or email them but, if you can't contact them, whst are you suppose to do?
