Self help evicted sent me into deep depression and now I’m out of it and want to take them down

Post Body

I was under contract with an apartment for a year. Searched online for places because my factory was closing the doors in Las Vegas due to the covid shutdown, paid everything with money orders, packed up and flew out to visit family for a week until my job started. On 3-2-2021 I flew out of town to visit friends but I realized around 3-7-2021 I had not paid my rent that was due on 3-5, so i called them and I was told they would instruct me via email on how I can make a payment online but got no word on that.. They wouldn’t accept online payments nor cards over phone, it was a terrible system of paying for stupid money orders monthly.

My work assistant hadn’t heard from me because my phone broke so I was waiting for a replacement and so he called my apartment complex on 3-9-2021 to check if I was there. So my landlord did a wellness check, and had sent an email to me stating they did a wellness check and to contact him asap to discuss my late payment in March, even though I had just been in contact with them JUST days before by phone… Then placed an orange sign on my door stating to contact them and changed the locks my neighbor said.

Another email was sent to me 3-17-2021 at the Township saying only this "Kevin – if you have vacated the premises, return the keys back to our leasing office, so we can close the account."

So I finally got another phone and saw those emails, promptly replying to both on 3-22-2021 and then made a phone call to the them the moment after reading. I was told that they “DEEMED” me a walk out for some reason that makes no sense, like I said, my job and few others knew I was leaving, and they didn’t bother to contact any of my emergency contacts I listed in the lease agreement nor my job? They knew exactly how to play the game because I was open and spilled the beans that I was backpacking for a month

I told them about me being in medical care again since 3-2-2021 and that we had already talked between then and 3-9-2021, and that just hours before ALLLL this, I woke up sick with heavy symptoms of Covid, and was currently under medical care being treated and obviously mandatorily quarantined.

So it is obvious they used my honesty to their advantage of the laws, filed certain things, but never could answer why my emergency contacts listed on my lease were not contacted nor AGAIN the common sense picked up from my documented phone calls regarding my unit and the rent🤷‍♂️

My question was unanswered and they said they posted notes on my door and had sent 2 emails and then they had changed my locks.

We discussed that I was being made arrangements for March's rent to be paid electronically and then the conversation abruptly ended.

9am 3-26-2021 I received a message from my next-door neighbor asking if I was moving out because there were people taking my items out of my apartment and placing them in the dumpster next to our building before he was going to work. I was STILL UNDER MANDATORY QUARRANTINE and could not fly home yet!

I called the the apartment and spoke with a man and he told me they had removed everything the day before, that the only thing left was a couch, my Ashley furniture bedroom dresser and bed frame, bed, and literally only 1 shirt. I asked about all my brand new appliances, dishes, vacuum, carpet cleaner, TV, bowflex, and MANY more items that was still there when I left. He said that he checked the apartment himself and that's all there was. I asked him how they got in my apartment, because they had to have unlocked it to get in, and he skipped the question again. I asked why my stuff was CURRENTLY being put in the DUMPSTER yet he said they did it days ago, (even though he said there was nothing there but my neighbor is literally watching them) and that the last thing they were having to disassemble, at that very moment we were speaking, was my home gym. The guy sarcastically asked for advice with a chuckle that made me SO UPSET which hurt because Covid was giving me terrible headaches and migraines almost every day for months after.

AGAIN, I asked why my emergency contacts were not notified, and to stop what they were doing and how we could resolve this issue and work together. How I can’t understand why I’m not even 20 days late on rent for the first time, I don’t even get an eviction notice to pack!

He said it didn't matter, the apartment terminated my contract and there was nothing I could do to continue living in my unit.

I asked how it was legal for them to do that, stating I could have been in an accident or heart attack, and so if those scenarios were to happen, how would I be able to reply by email or a note posted on my door.

And back to why was there no eviction process attempted, that they thought throwing away my hard earned and treasured valuables and a lifetime of memorabilia was any kind of justification..

He wanted to end the conversation and then gave me his email to write down saying he would give me a positive reference for another landlord and hung up!!!! I had to laugh at that point. The guy was a dick..

So I immediately contacted the Kansas City police Dept and after a lengthy report, the officer's supervisor said since I couldn't be at the apartment at that moment to meet the police, it would be a civil matter due to my covid hospitalization in another state and no family present at my apartment. The neighbors couldn’t help stop anything. I called my job which employs lawyers for employees, and I was referred to contact the KANSAS CITY HOUSING AUTHORITY for eviction help, and that it would be cheaper and more effective that way.

He said that there's no records of me being in the case net site for any eviction process filed, and said to call the Kansas City Housing Authority and get back with him if he was still needed. I placed a call and was told I was going to be called back and they told me I make too much to get any help. I didn’t understand, I was sick, and just didn’t know what to do in such a helpless time..

Please help assist me on what to do next. I got my car shipped, all my belongings are in the trash my neighbor said, literally all my momentous and things made or given to me that meant the world to me, along with my tax records being processed with my laptop that all was laying on the kitchen counter when I left… along with my notebook of information, records, so much personal info…

I was told to contact my renters insurance about what the housing authority did to my stuff and they said it was covered but I had to get an itemized list of my things and at that very point and time In my life, I was already dealing with how I was getting back home, the remaining vacation days I had left vs the time I’m trapped with covid across the country.. so I just gave up and focused on surviving the 2 jobs I was working to live. They sent me a lawsuit for unpaid rent for the remaining months of my contract after my insurance closed their case but contacted them about their side of everything..

I was so depressed for a long while because I tried calling some lawyers and the paralegals were very positive the whole thing was illegal, certain things weren’t filed, no deputy sheriff was dispatched which is SUPPOSED TO BE BY LAW in the state of Missouri..

I just don’t get it. Why did I even deserve this? I’m being told many times this was shady and illegal.

Yet it seemed like I wasn’t a big enough fish to fry or something? So I felt like there was no case and gave up the idea of a lawyer helping someone like me..

I’m coming up on 3 years sober from liquor now, still in the state I got treatment, even started working for the facility in a corporate position on my year anniversary, which was surreal.

The lawsuit they sent was a few months ago. I let it go for a while cuz my roommate likes throwing my mail away, but my sponsor says this is a test I need to face and I need to try and sue the apartment complex to keep them from doing other people dirty (which they have for certain after me)

Is there statute of limitations on suing them? They literally left me stranded in another state broke with the clothes from my backpack trip. I couldn’t go back to my job because I had nowhere to live, would have to buy more steel toe shoes and other things needed in life…

and no family around.. I want some compensation for the items I lost at the very least. Is that too much justice to ask for?
