Hello. I have had an interesting case occur when doing my first inspection for a vehicle I purchased last year, as is required in my state, New York. Is there any legal action that can be taken since I am feeling targeted, as I have been a lot for driving this vehicle? I understand that I am capable of making a complaint to the DMV against the inspection station, but after trying to have a civil discussion about the state I found the parts at fault he was quite abrasive and aggressive. But of course nothing is "reportable" by itself.
The vehicle in question is a 2019 Tesla Model 3's rear brake rotors (yeah not front ones) being "rusted through" the inspector's literal words. I then did the only logical thing a capable human could do and ordered replacement rotors and brake pads for the rear of my vehicle, as that was the ONLY concern for it failing the inspection. Today when I went to replace them after taking time off my job to do so, I found they were in almost new condition as you would expect for a car with alternative braking systems. I took them to O'Reilly's to turn them, and the person tried to refuse due to the condition not needing turning... "THESE failed inspection" was his response when I said that was why I wanted them turned. I returned this afternoon for the follow-up inspection after doing the exact fix they wrote down for me and they failed it again for the front rotors. They even showed me (I should have taken a picture) their notes for yesterday's service it said "Front brakes of no concern for inspection" or the equivalent. Both sets of rotors have only some surface rust that you get from bringing your car outside... ever.
I also reviewed CR-79 and found nothing regarding the brake requirements that was even close to causing my vehicle to fail in its perfectly fine condition... during the second visit they stated it was due to this section "79.21.13 - Distortion or scoring impairs the braking system" This is what they repeatedly said to me, and since anything could technically impair a brake's performance, even a fingerprint on a brand new brake that has never been used would change the way a brake works to some degree, obviously trivial beyond measurement.
Is there anything I can do for them wasting 2 days of my time AND keeping me from my job for a day (which is a 10-hour day) for something that does not hinder my car's performance whatsoever, in any way at all? Other than complaining to the DMV about this inspection station.
