Can I withold rent from my landlord because they are renting me an illegal apartment? This is in Massachusetts. Basically long story short is I've had many back and forth battle with my landlord over habitable/functional living spaces in my apartment since I moved in 2 years ago. Recently it has come to my attention that my bedroom is not legal. I've contacted the city building inspector and they have confirmed that my living space is indeed not a legal bedroom. Because of this I believe the landlord has breached our lease agreement and is violating the state warrant of habitability. I would like to withold rent until my lease is up at the end of August, or until the building inspector can come by and deem my apartment as illegal and insist that I vacate the premise.
Any help or advice is appreciated!
