I was pulled over and fined for throwing a cigarette butt out the window but I didn’t. It was the ash of the cigarette that went out the window. I was still holding the cigarette butt when the cop came up to my car but he claimed it was an old butt and he clearly saw me do it. I requested a review and it was rejected and I requested any dash cam footage of the event but the police say there is no footage. So it’s just the word of the cop as proof of something I didn’t do.
I want to elect to be prosecuted and fight it. Can I be found guilty based on the word of a cop alone? I’m in South Australia so only SA Law is relevant. Thanks for any help people’s.
