So a couple days ago I had gotten bite by a dog and had to spend the night in the ER getting my forearm and the palm of my hand stitched up. When I called into work letting them know I was not going to show up the following day as my doctor had told me that I had a high risk of infection so I should rest and let it heal. I asked if my absense would be excused due to my situation and they informed they are a "no fault" workplace meaning If I recieve 12 points I will be terminated. If I didn't show up I would still recieve the points on my attedance and whats even worse is the bite happened a day before mothers day or so if I call off I'll be given double points considering it is a holiday. I work as a busser inside a casino on an indian reservation so I'm confused on how my protections differ federally from those in California. I've talked to in HR have told me I am not eligible for medical leave as I haven't been at the company long enough. As well my managers insist theres nothing I can do in having my points removed from my attendance. I would just like a little insight on my rights as a worker and how I am protected under the federal government in this situation or if I even am protected. I appreciate any advice you guys can give me.
