TDLR: employer fired me 2 days before last day of my notice and told me they’re docking uniform out of my paycheck regardless of return.
I worked at Steak ‘n Shake out of Georgia, they let me go 2 days before my last notified day “because they had no choice but to assume I would not be there.” That’s not true because I told multiple people I’d be there, gave a time and let them know I’d be late. But honestly that’s not important because I’m in a at will state.
I got a call today from a previous coworker (manager) about unrelated happenings at the store the night before, but he started trying to explain why I was let go when I was. He told me I was actually going to be let go regardless, “for business reasons.” Which is completely different from what they told me before.
All that lead into the topic of ,”I’m going to turn my aprons in as soon as tonight, just had to wash them first,” and he let me know while that was nice, it wasn’t necessary because they’d dock my check anyway. So I asked, “is that in the handbook,” after he told me it was policy. He told me, “I don’t know they told me that during orientation.” When I let him know that’s not how my orientation went he said something to the effect of, “well I’m just telling you how I was trained.”
I let him know that was fine but I’d definitely be letting Greg (district manager) know that I plan to get all of my check and I’ll talk to his dad (owner) if necessary.
My biggest question here is do I have any legal leeway? Do I go to the labor board? Who is best to consult about this?
