I live in Virginia. I'm interested in suing a multinational business in small claims court. They are headquartered in Florida, and don't appear to have a physical presence in Virginia from what I can tell. However, they actively market in Virginia (I've received mail flyers), and I purchased their services while in Virginia (online and via phone).
On Nolo, it states you can't sue another entity that doesn't have a presence in your state, except for under certain exceptions, one being:
the business does regular business in your state by selling products or services, employing a sales rep who calls on you personally or by phone to solicit business, sending you a catalog to solicit your business, or placing advertising in your state's media.
I believe my case falls under that exception, but I'm not sure how to actually serve them. I've never been involved in a lawsuit, so this is new territory for me. I'm looking to sue them for $5,000 (purely coincidentally the maximum allowable by small claims in VA).
Any help would be appreciated.
