For context, I paint miniatures and take pictures of said miniatures. My local tabletop games store has a discord server for the local community, segmented into different categories for the various different gaming communities and hobbies. Myself and others do post pictures of our completed and in progress miniatures in this discord server, there is nothing in the community rules that states by doing so we grant the owner permission to use pictures posted in his advertising anywhere. The owner of this game store recently posted an advertisement for a painting competition on the stores Facebook page using pictures that I have taken of my in progress miniatures in the ad, without seeking permission or giving credit for these pictures. I personally wouldn’t have cared if he sought the permission first to use them in his ad, and I’m fairly certain that posting to the discord server doesn’t give him Carte Blanche to repost my pictures. What are my options from a legal standpoint?
