My wife and I have a swinger dating profile. It is a very brief profile description aimed at meeting folks to go naked hot tubbing with. The entire profile is very mundane in comparison to what it could be. The photos are blurred but if asked if the photo is us, one could positively identify us to a high degree of certainty. However, our location is set to two states away. Basically you'd really have to look to find our profile, especially since we only engage people in the vicinity of where we might be traveling to. We never even search in our own state. Although we do have this profile on a swinger dating site, it in no way states or even hints to anything other than a search for open minded friends to hang out with when we travel.

Along comes my wife's stalker ex-husband. He proceeds to show their (12M) son our profile and tells him that his mom is filming porn for money and that he's not allowed to travel with us anymore. He tells their son that other people pay to have sex with his mom and that she has a lesbian relationship with a woman in the state we have listed as our location. Although he is aware that this has been a lie concocted by his father, we were forced to be honest with him and tell him that we have friends that we hang out with sans clothing. Everything is as good as can be expected on the home front and we feel like we have effectively done damage control. (For reference, 50/50 custody with no primary. He cannot keep us from traveling with my stepson, he's just being a blow hard.)

My question is, is there anything we can do legally to prevent this sort of thing from happening again? I'd like to sue him, but I don't know on what grounds. Hitting him in the pocket book would be a good deterrent. Would this be something that could be prosecuted criminally?
