So i am the lessee in this situation.

I leased a product via closed end lease for a business. If it grows business, then i have option to buy. Sounds all good and normal so far.

Now i signed the lease last week of nov. In the lease the expected arrival date of my equipment is TBD fair enough supply chain issues whatever.

It's been 2 months now with still no update on the arrival of my equipment.

I dont see a way out of the lease from my end (except default which isnt An option ill take) OR they cancel the lease i pay any outstanding amounts due (0$) and what ive already paid.

I worked my way up to a meeting with some sales manager tomorrow. So far customer support has put it on me to find out from a 3rd party vendor on when they shipping my equipment....

HERES THE KICKER! Pretty sure the 3rd party is out of business. After hours mailbox full. 20 calls all hours no matter what get after hours message.

Options i see.

  1. Somehow convince them to terminate the lease
  2. Make all payments then actually sue for some sort of mis representation.
