My neighbor killed my dog.

My dog was in my neighbors yard and she text my husband to let him know. He called me, i immediately went outside to retrieve the dog. His name was Tank (he was a corgi). As I approached the fence that separated our property she was behind him shooing him back to our side and Tank was walking towards our home. My neighbor was within a foot of him continuing to follow him. When Tank saw me on the other side he turned around and started barking at her and befor I could lift the gate latch she shot my dog and killed him. She shot him in the throat, he bled out. I watched the entire thing. I need legal advice as far as if she would be justified in court in California. Thanks guys.

Did you just ask what if the neighbor didn't have the ability to defend themselves? Did you miss the part where they shot it with a gun? Seems like they were able to defend themselves. What they did was kill a dog that had not touched them in front of its owner who was actively retrieving it. That's not self defense

The bacteria in a human mouth can be potentially fatal just like a dog's. The main bacteria of concern for infection from a dog bite is Capnocytophaga, which is also found in the mouth of humans. They are mammals just like we are, so we have pretty similar bacterial biomes

How is the weight of the dog relevant? Go look up human deaths caused by dogs and tell me how many of those are under 30lbs. Use your noggin. Also, how is your "what if it bit the neighbor/child" question relevant? It didn't. End of story. Imagine if I shot you and used, "what if they had tried to murder me? Facts disagree with me? What are you, 12? She was in the process of regaining control of her animal. The neighborly thing to do would be to not kill an animal that isn't attacking you in front of your neighbor. Only a lunatic who says things like "facts disagree with you" would argue otherwise.

Yes, if your neighbor's dog is 25 lbs and being retrieved you should wait for it to try to bite you before you LITERALLY KILL IT IN FRONT OF ITS OWNER. No one has ever been hurt by a bark.
