My dog was in my neighbors yard and she text my husband to let him know. He called me, i immediately went outside to retrieve the dog. His name was Tank (he was a corgi). As I approached the fence that separated our property she was behind him shooing him back to our side and Tank was walking towards our home. My neighbor was within a foot of him continuing to follow him. When Tank saw me on the other side he turned around and started barking at her and befor I could lift the gate latch she shot my dog and killed him. She shot him in the throat, he bled out. I watched the entire thing. I need legal advice as far as if she would be justified in court in California. Thanks guys.
Yes, you should wait to be attacked before you shoot your neighbor's dog. What kind of nutjob are you?
Did you just ask what if the neighbor didn't have the ability to defend themselves? Did you miss the part where they shot it with a gun? Seems like they were able to defend themselves. What they did was kill a dog that had not touched them in front of its owner who was actively retrieving it. That's not self defense
And? Being afraid doesn't justify killing. My grandparents are afraid of black people. By your logic, they are fine to kill any and every black person that steps on their lawn
All those words just to say nothing at all. When did I ever say it wasn't legal?
I already answered that. Please stop going in circles.
Yes. The victim is the one that got shot for barking 20 feet away from their own home. Not the person who checks notes got barked at. Are you really this dense?
Alone in a parking garage with a screaming man sprinting towards you and in your yard with a 30 lb corgi barking at you while it's owner/your neighbor is coming to retrieve them are two wildly different scenarios. If you can't understand the nuance between the two, please don't carry a gun
You don't have to right to kill or destroy something just because they don't have rights. I can't set your car on fire if you park on my lawn.
The bacteria in a human mouth can be potentially fatal just like a dog's. The main bacteria of concern for infection from a dog bite is Capnocytophaga, which is also found in the mouth of humans. They are mammals just like we are, so we have pretty similar bacterial biomes
That's like saying "yeah he shouldn't have raped her, but if you let your daughter out dressed like that, these things can and will happen." There is only one party in the wrong here. Blaming the victim isn't the way
Fun fact, you do live in this world. Stop being so afraid of everything. You even said you've carried for 10 years and haven't had to use it... Seems like you aren't as trigger happy as you claim to be. It's almost like you're just trolling for engagement or something
Not sure you comprehend that just because something is possible doesn't mean that outcome is likely to happen or will happen. What kind of lunatic starts shooting things based on "well it's not impossible that it's not a threat." Also, if the neighbor is disabled or elderly, it appears they had a firearm to protect them in the off chance that they were attacked...
How is the weight of the dog relevant? Go look up human deaths caused by dogs and tell me how many of those are under 30lbs. Use your noggin. Also, how is your "what if it bit the neighbor/child" question relevant? It didn't. End of story. Imagine if I shot you and used, "what if they had tried to murder me? Or a child?!" as my defense in court 😅
Excellent logic... You've got teeth and bacteria in your mouth too pal. Doesn't mean you should be shot in the throat for it. Especially if you're not biting anyone with said teeth and mouth
Shoot your neighbor the next time they come on your property
Facts disagree with me? What are you, 12? She was in the process of regaining control of her animal. The neighborly thing to do would be to not kill an animal that isn't attacking you in front of your neighbor. Only a lunatic who says things like "facts disagree with you" would argue otherwise.
Yes, if your neighbor's dog is 25 lbs and being retrieved you should wait for it to try to bite you before you LITERALLY KILL IT IN FRONT OF ITS OWNER. No one has ever been hurt by a bark.

You think shooting your neighbor's dog in front of them as they are actively coming to retrieve the dog qualifies as doing "nothing wrong?" I would argue it's a disgustingly immoral over-reaction
