Safer to apply for AOS and green card during or after 90 days, on ESTA?

My partner came over from Australia in August hoping for a work visa that has since fallen through. He is still here, now officially having overstayed the 90 days, by a little less than 3 weeks.
Options for consideration:
- He leaves the US to reset the 90 day ESTA and then we get married during the 90 days
- We get married ASAP and apply for AOS and go down green card process, despite his overstayed status.
I know the 90 day rule isn't in effect anymore, but it still seems like it would be worse to apply for AOS during the 90 days versus in a small window of overstayed time???
