I'm trying to find some information to help a client in any way that I can.
They have been in the US for about a year, through the work-visa that their spouse is here on. I learned that they are planning to get a divorce; so to my understanding, they will have to find a business to work for that will take on paying for their own work visa, and this may prove tricky due to the field that they work in.
They state that there is a chance they can prolong the divorce, with their spouse allowing it, in order to give themself more time. However, their preference would be to have the separation be complete, as they've noted that the spouse has been emotionally and mentally abusive to them for some time.
It is my understanding that even living apart for too long could nullify the marriage and terminate the visa-arrangement, anyway.
Are there any resources or rights for the spouse of someone who is here on a work visa following the divorce from that spouse?
