Siri not responding to voice

I needd Siri help!
7th generation model.
Siri will only activate if you hold the home button and won’t respond to voice commands. Should I return to seller or is there a fix? I
I’ve troubleshooted all night and really don’t want to send it back and wait a week for another one. Turn off and on the device, Siri, airplane mode, wifi. I have Eve reset the device and started all over again
