We recently opened a location in California. Due the nature of the industry, turnover is pretty regular.
I'm trying to figure out how to deal with final paychecks and wondering if anyone can share how they do it.
Based on my reading of the law, we must give them their final pay within 72 hours of them quitting or immediately if they are fired. And we cannot use direct deposit for final check without additional written permission.
This becomes difficult because we have to coordinate with HR to calculate taking out taxes and then get the local manager them to write a check.
The real problem though is tips because we use a tip pool. It's pretty standard to calculate that at the end of the pay period, but it's not really possible to calculate before the end of the shift.
We've taken to not firing employees on the spot when necessary and just asking them to go home and then firing them when they come back during their next shift to buy us some time. But this isn't ideal because we have to pay them extra for both sending them home early and for them showing up.
