Why there isn't any other CPU Manufacturer

In the last days, I was thinking why only AMD and Intel makes CPU, so I've found out some old posts about licensing. But I wasn't able to understand something.

So let's pretend that I am building a CPU based on X86_64 instructions set, I implement the instructions in my own way, now can Intel or AMD bring me in the court because I am implementing instructions sets like 'mov', 'db' and others which aren't a part of Intel/AMD Xeon/Epyc sets or Virtualization sets?
