Tern D-8 handlebar stem folds repeatedly while riding

I have written to Tern several times with no response. I have a D8 which is otherwise a great bike, but sometimes when I hit relatively small bumps this main hinge on the handlebar stems folds towards me. I catch it in time and fold it back upright while trying to lock it, but the little silver bit which is supposed to lock the hinge doesn't click. Actually it has never clicked, and when I first got the bike it jiggled a bit but never outright folded, now it has started folding while I am riding and it's a little worrying. Is this common with the D-8? Anyone else encounter this? Anyone have a solution? Do I need a new hinge? Tern remains unresponsive after several emails, any other approach to reach them? Would this qualify as a manufacturing defect?
