I rewatched the tribunal episode and I found out the truth. Mark has fooled as all and I will not let it stand!
While writing the distractible constitution the group gave each of them the option to appeal to the subreddit if they thought the result of the episode was unfair but they could only do this once per season. Mark had already used his one and only one appeal towards the subreddit before the fabled plastic spoon debacle meaning marks appeal to the subreddit for said debacle is unconstitutional and should be overruled
Where I think they got confused is that they also outlined the option to throw a red flag during an episode and each of them got two red flags in addition to their one and only one appeal to the subreddit. What the red flags did however was more specifically related to if the point tracking had been done fairly and note necessarily relating to the result of the episode. During the episode of the group found that the point tracking was indeed done unfairly then the host would be forced to use the wheel to decide the result of the episode.
Mark cold if used one of his two red flash during the episode in question however since the issue was with what item Bob gave to mark and not the actual points it wouldn’t have (or at least shouldn’t have) been viewed as unfair as the points were assigned fairly it was giving mark an item as arbitrary as a plastic fork that was unfair not the points themselves
Edit: I say Mark should do a one man show bonus episode for daring to break the sacred constituents of distractible
