I’ve searched this sub and wasn’t able to find an answer. For various reasons I went into some serious debt several years ago. Over the past few years I’ve whittled it down significantly with the help of a debt relief company. Earlier this year, Discover lawyers took me to court and claimed that they were unaware of any negotiations with a debt relief company. The company assured me that negotiations with Discover were ongoing. A second hearing was scheduled after I explained things to the judge. During the second hearing I explained that negotiations were ongoing, which I understand the courts don’t care about this. After explaining to the judge that I couldn’t pay any extra right now he issued a consent judgement. In the meantime my debt relief company came to an agreement with Discover and the payment plan is pending.
Since then, I’ve received two letters and some emails from the Discover lawyers with a Settlement Stipulation and a payment plan. It stated that I had to sign and return it within 7 days or they would take further legal action. I’m hesitant to sign and return this because I don’t want to pay them twice; direct payment to them and then payment through the debt relief company.
Not really sure what to do. The debt relief company says that they can’t give me legal advice. Anyone have an opinion on what I should do? Thanks in advance for any help.
