Literally set up for failure

How do you deal with a professor that has literally set up an entire class of 500 students to fail an exam? I just took a general biology two exam that our professor gave us 40 minutes to answer 45 questions on an open book open note test? He did not provide a timer and used a test bank that was fairly large and questions that were really long. With 53 seconds per question half of the students didn’t even finish their exam and another quarter of the students failed. We have asked him numerous questions about the timer not being there, how much time we had, the ability to use our notes or not, etc. He has pretty much given no sympathy to any of us and has pretty much responded with I don’t care or that’s your own fault or maybe you shouldn’t cheat because his reasoning for setting the exam up like this was because on our last exam as he says 50% of the class cheated. I feel like something needs to be done about this but I truly have no idea what to do because I feel like anything I try to do is going to be met with the same responses. I am never one to complain about the way professors handle things, usually they are reasonable and even if they’re not I can usually see their side of it but this is absolutely ridiculous.

Update: after numerous one on one meetings with students and consideration for all points of discussion our professor dropped the exam grade and is counting our highest exam grade twice!!!
