Are there any employment lawyers out there that can answer a specific question?
My employer attempted to reduce pay last month of the top 3 employees. As I am in payroll (and also 1 of 3 out of 15 employees he wants to reduce pay) , I advised him (as advised by Employment Standards) that he would be required to provide the required notice as the reduction was deemed âconstructive terminationâ.
Now, he is attempting to do this again and with an implied threat to ensure they take on tasks that are outside of their scope and job requirements.
Another note is that he is implying this pay cut is across the board, when I know that that is incorrect.
I understand that he is still required to provide notice (however, he has a long history of not following employment standards and has refused to pay former employees their final pay) but, I was advised that he is required to provide these employees proof that he is cutting all staffâs pay and not just selective employees, which he is. Is that true and if so, could someone kindly provide the BC employment standard laws surrounding this, as I have not been able to substantiate this and would like to be as well informed as possible.
If anyone has any insight, please, I would very much appreciate it.
